Kochi : The Kerala High Court will consider a petition filed by the two Italian marines and the Italian Consul General today in connection with the killing of two fishermen off the Kerala Coast on the 15th of this month.The petition seeks to quash the FIR registered in connection with the case. Our Correspondent reports that the petition filed by the Italians reiterates the stand already taken by them in connection with the killing of the fishermen. The petitioners contend that the incident took place not in India’s territorial waters and hence Indian laws are not applicable. Further, it states that the marines were on official duty and have functional immunity.They should be tried and prosecuted only in Italian Courts, where already an investigation has been launched. Meanwhile, considering the petitions moved by the kin of the killed fishermen, a Division Bench of the Kerala High Court yesterday extended the detention of the Italian vessel till 5 pm today. The weapons, seized from the vessel were produced before the Chief Judicial Magistrate’s Court at Kollam and were later taken to the Forensic Science Laboratory at Thiruvananthapuram.”
