  • In a Landmark Judgment Court Attaches Property of Employee to Recover Siphoned Money

    Hyderabad: In the high profile case involving M/s. Tilaknagar Industries and its ex-employee Mr. Benedict Williams, the Joint judicial magistrate of Shrirampur, Maharashtra, has requested the District Magistrate of Hyderabad to attach the immovable property of the latter located at Ankul apartments, Ashok nagar, Hyderabad. A letter to this effect has been sent to the District Magistrate, Hyderabad for appointing a Receiver and to file a compliance report before 15-09-2011.

    The order comes in the wake of a case filed by Tilaknagar industries against Mr. Benedict Williams, ex-Senior Vice President (Sales) for filing forged documents and affidavits in the Courts. Another complaint for cheating and misappropriation of company’s funds under the guise of tour and lucrative business proposal has also been filed by Tilaknagar Industries against Mr. Benedict Williams.

    The company terminated his services and was constrained to file FIR bearing No. 192/2010 against Mr. Benedict William with the Shrirampur Police Station, limits. The company was also constrained to file an FIR bearing no. 43/2010 against him  for forged signature on the affidavit in Anticipatory  Bail (in first FIR) bearing no. 150/2010 filed by the accused  before JMFC, Shrirampur Court and the order for attachment has been passed under this complaint.

    Thereafter, the Hon’ble Court directed Shrirampur Police to investigate the forged documents u/s. 156(3) Cr.PC for which the presence of Mr. Benedict William i.e. accused was required before the Police station for investigation.

    However, he failed to either co-operate with the investigation authorities or present himself before the Hon’ble Court on various dates. Therefore, the police issued summons and warrant of arrest which was avoided by accused.

    However, since he kept on hiding, the police could not trace him even at his permanent address at Hyderabad. Consequently, the police filed their report before the Hon’ble Court that inspite of warrant issued to accused, the police could not trace him for any investigation.

    Therefore, they filed their report on 30.3.2011 before the Hon’ble Judicial Magistrate First Class, Shrirampur District. Accordingly, the Hon’ble Court passed order of proclamation on 7/5/2011 after giving him sufficient time to present himself under Section 82 of Cr.PC, and taking the record that the accused is absconding directed for proclamation in newspapers to be published in Hyderabad and Chennai and to thereby order the accused to remain present on respective dates. In spite of that, the accused chose not to remain present before the Court. On failure to adhere its order, the Hon’ble Shrirampur JMFC finally passed an order of Attachment of Property of the accused.

    Since several attempts to nab the accused proved futile, the honourable court thought it fit to attach the property and claim the money siphoned off by Mr. Benedict William. Public notices were issued in several newspapers across Pondicherry, Hyderabad and Chennai to trace him. However, the accused managed to run away from one place to another.

    M/s. Tilaknagar Industries Ltd. has been achieving top growth in a sustained manner with new benchmarks of excellence through expansion and value-improvements in its activities. But some disturbing elements have been trying to swipe at the company with their diabolical activities and the company has been forced to act sternly to safeguard its image and interests at all costs.”
