  • High Court quashes acquisition of over 100 hectares of land by UP govt in Mathura district

    The Allahabad High Court set aside acquisition of more than 100 hectares of land by the Uttar Pradesh government in Mathura district for promoting tourism and developing residential colonies. The court held that invoking of urgency clause was not justified. The order was passed a division bench comprising justices Sunil Ambawani and Kashi Nath Pandey on a batch of petitions.

    The petitioners owned over 110 hectares of land in Azizpur village of Mathura, which was acquired in August 2007-08. The petitioners had moved the court contending that invocation of the urgency clause deprived the owners of their valuable right to raise objections and negotiate for adequate compensation.

    The High Court had in May quashed the acquisition of more than 150 hectares of land in Shahberi village in Greater Noida and, subsequently, an appeal filed by the state government challenging the order was set aside by the Supreme Court.

    AIR Correspondent reports, the Allahabad High Court has cancelled acquisition notifications under which the state government had acquired110 hectare land in Azizpur village of Mathura district .The land was acquired by Mathura Vrindavan development authorities in 2007and 2008 for residential scheme .

    The High court bench comprises Justice Sunil Ambavani and Justice K.N.Pandey set aside the acquisition notifications and ordered that the if any portion of land and was it should be returned to land owners.

    In another cast the same bench imposed two crore rupees fine on two builders of Gaziabad who illegally acquired a plot in Dudhera village which was allotted for dumping yard .The builders approached to high court against this proposed dumping yard .but Court rejects their plea .

    The High court bench also set aside the land acquisition in Gallanad village of Ghaziabad .The land was acquired for another dumping yard there.
